The Patrick administration announced on June 4 that the state has reached a tentative settlement agreement in the Hutchinson case, building critical community service capacity for individuals with an acquired brain injury.
The Hutchinson case was filed in early 2007 by five individuals and the Brain Injury Association of Massachusetts, in Westboro, on behalf of all persons who acquired brain injuries after the age of 22 and were living in nursing facilities or were at risk of entering nursing facilities. The suit claimed the state did not provide adequate community care alternatives so that individuals with acquired brain injuries could live in the community.
Under the settlement, the state will create a new home and community-based services program to be managed by the Massachusetts Rehabilitation Commission. As part of this initiative and within three years following federal approval, the state will offer community residential and nonresidential services for up to 300 persons with acquired brain injuries who are in nursing facilities and rehabilitation hospitals.
