SHREWSBURY - A local police officer has sued the town, alleging it is refusing to put him on injured-on-duty status even though he continues to have medical problems related to a work-related accident two years ago.
Michael P. Clancy, a Springfield attorney
In the lawsuit's complaint, Officer Wnek, 36, of 568 Malden St., Holden, said he was struck by a motor vehicle while on duty June 29, 2006.
He has received medical treatment for the injuries and at various times has been unable to perform his duties as a police officer, the suit maintains.
The town initially accepted Officer Wnek's injured-on-duty claim, which paid his medical costs and salary while he was out of work.
The complaint said that since returning to work on Oct. 3, 2006, "he has continued to suffer from the effects of the trauma suffered on June 29." Documentation to support the claims has been provided to the town, the complaint said.
The complaint contends that the town has improperly denied injured-on-duty status and that Officer Wnek's damages include loss of sick days, vacation days, medical costs indemnification and wage replacement benefits.
The officer is requesting a jury trial.
Police Chief James Hester Jr. was out of the office yesterday and could not be reached for comment.
Town Manager Daniel J. Morgado said the town has not been informed of the suit.
Officer Wnek, reached at his home, said he could not discuss the suit.
