TenFold Favorably Resolves Customer Dispute with Ohio Farmers Insurance Company.

TenFold Corporation (Nasdaq: TENF), a provider of the Universal Application(TM) and large-scale applications, today announced the resolution of a customer dispute with Ohio Farmers Insurance Company.

TenFold signed a contract with Ohio Farmers

in March 1999 to deliver a policy management application. In July 1999, Ohio Farmers terminated the project and both parties asserted demands for damages under the contract. Litigation between TenFold and Ohio Farmers commenced in the fall of 1999 in federal court in Cleveland, Ohio, with each party contending it was entitled to recover money under the contract. TenFold subsequently filed a motion for partial summary judgment seeking dismissal of the Ohio Farmers' breach of contract claims. While awaiting a ruling on that motion, the parties agreed to explore settlement options in a non-binding mediation. On April 26, 2001, Ohio Farmers and TenFold settled their differences, and as part of the settlement agreed to dismiss all claims against the other without either party admitting liability. TenFold's errors and omissions insurance carrier paid the compromised and confidential settlement sum above the $25,000 of self-insurance retention paid by TenFold to cover legal defense costs. The parties are in the process of dismissing the case in its entirety.
